State Issues Final MBTA Communities Regulations for As of Right Multifamily Zoning Districts
The new law creates zoned capacity of 283,496 multifamily units by right.

On August 11, the Boston Planning & Development Agency (BPDA) approved a new policy that requires Large Projects subject to the Article 80 review process- those that exceed 50,000 square feet in new construction or additions- to file a DEI Plan Disclosure around their plans to include people of color, women, and Minority and Women Owned Businesses in their project, and specifically to provide information around economic participation, employment, and management roles for members of these groups.

In addition to Large Projects, this policy applies to Planned Development Areas and Institutional Master Plans.
The DEI in development policy is designed to increase diversity in large development projects, and it builds on an existing BPDA policy adopted in 2018 that requires bidders on publicly owned development parcels to submit diversity plans as part of their bid.

The DEI Plan Disclosures required under the new policy will not be used at this time to evaluate project proposals submitted under Article 80. The BPDA will study the results of the disclosures and intends to recommend the policy for inclusion in the Boston zoning code in the future.
